Buying a Long Island House With a Cesspool: What to Ask Before You Sign

Fenced backyard lawn with houses beyond

First: a cesspool isn’t a deal-breaker

Nearly 70% of Suffolk homes are on cesspools or septic systems, so if you’re buying in Suffolk, odds are good the house you love isn’t on sewer. What matters is the condition of the system and who pays when it needs replacing.

The home inspection probably won’t cover it

Most home inspections don’t test the septic or cesspool. You need a separate evaluation from a cesspool or septic contractor. And be careful with the classic dye test: it only shows that the system took a load of water on the day of the test. It says nothing about whether old block walls are about to cave in, or how close the soil is to clogging.

A useful evaluation:

  • Locates every ring or tank (many houses have more than one)
  • Pumps it, so the walls and bottom can actually be seen
  • Checks the structure: block, brick or precast, cracks, settling, the inlet pipe
  • Notes how fast it refills, and how deep the groundwater is
  • Ends with a written report, photos, and a replacement estimate if needed

Questions to ask the seller

  1. When was the house built, and has the system ever been replaced? (Pre-1973 Suffolk houses that were never upgraded almost certainly have a cesspool.)
  2. How often has it been pumped? Ask for receipts. More than about twice a year means it’s failing.
  3. Has it ever backed up, or has the ground over it ever sunk?
  4. Is the street in a sewer district or a proposed one? (That decides whether a septic grant is even possible.)
  5. Is there a Certificate of Occupancy that matches the house? (The grant requires a valid CO.)
  6. If there’s an I/A system: is it registered, and is the maintenance contract current?

Price the replacement into the deal

A failing or old block cesspool is roughly a $10,000–$25,000 problem for a conventional replacement, or $15,000–$30,000+ for an I/A system before grants (East End reporting: $35,000–$40,000). See the cost guide. Use the evaluation to negotiate a credit or a lower price.

Watch out for a rushed seller “fix”

The Suffolk grant can only be applied for once the deed is recorded with the County Clerk, and it must be issued before installation. So a seller who “replaces it before closing” will almost always install a conventional system with no grant money. Sometimes that’s fine. But if you’d rather have an I/A system mostly paid for by grants, a price credit and doing it yourself after closing may be the better deal.

After you close

  • Pick an installer from the County’s SIP-approved list (get a quote here); they handle the grant and County paperwork with you. If the evaluation documented a failure, give it to them: failures are prioritized.
  • The County SIP grant isn’t taxable income for homeowners (IRS Announcement 2022-26).
  • In Southampton, East Hampton and Shelter Island, there’s town money on top. See your town page.

Does Suffolk require an upgrade when a house sells?

We haven’t found a County rule that requires an upgrade just because a house is sold. County materials list property transfer as one occasion when systems may be upgraded. Lenders and buyers often push for an evaluation anyway, and town rules can differ, so check with the town.
